Some Music Downloading Questions Answered

There are many questions about downloading music. Here are some answers to help you with those questions.

1. What if I download sound recordings? Is this still a violation of copyright laws? Yes it is if you download or upload full-length sound recordings without the permission of the copyright owners. You can’t copy someone’s work unless you know it is not copyrighted.

2. If a recording is no longer in print can I offer downloadable sound files of it? The owners of sound recordings have the exclusive right to reproduce and distribute it. Even when a recording is out of print it is still illegal to reproduce or distribute it without the permission of the sound recording copyright owner.

3. If the digital files I download are less than CD quality is it legal to download them? The quality does not matter you still need the authorization of the sound recording copyright owner.

4. What if a website doesn’t display a copyright notice? Can I still download it? Almost every work in the U.S. created privately after March 1, 1989 is protected and copyrighted even if it does not have a copyright notice.

5. Can’t I use the First Sale Doctrine as a way to share my own music? If you buy a CD and give it to someone that is fine. If you buy a CD and make copies of it or make it available to be downloaded on an internet site, that is not legal.

6. Can I download a sound recording and leave it on my drive for less than 24 hours and avoid copyright violations? No. The time you leave a recording on your drive has nothing to do with you being in violation of a copyright law.

7. Does downloading music on the internet hurt anyone? It hurts the composers, producers, musicians, sound engineers, publishers and vocalists.
